Agreement to Terms

By downloading, installing, or using Pulse ("the app"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

Description of Service

Pulse is an iOS application that provides audio reactive visual generation and music visualization tools. The app allows users to:

• Create custom visual layers that react to music
• Apply visual effects and filters
• Use preset visualization templates
• Record and export visualizations (Premium feature)
• Import and analyze audio files

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Pulse for personal, non-commercial purposes, subject to these terms.

Free and Premium Features

Pulse offers both free and premium features:

• Free Version: Includes 3 layer slots, one preset template (Pulse), and all visual effects
• Premium Subscription: Unlocks 6 layer slots, all premium templates, screen recording capability, and unlimited custom template saves

Subscriptions

Premium subscriptions are available on a weekly or yearly basis:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Weekly subscription includes a 3-day free trial
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• No refunds will be provided for any unused portion of a subscription term

User Responsibilities

You agree to:

• Use the app only with music and audio files you have the legal right to use
• Not use the app for any illegal or unauthorized purpose
• Not reverse engineer, decompile, or attempt to extract the source code of the app
• Not distribute or make the app available over a network where it could be used by multiple devices at the same time
• Comply with all applicable laws and regulations when using the app

Intellectual Property

The app and its original content, features, and functionality are owned by Gigapixel Apps and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to the visualizations and recordings you create using the app. However, you are solely responsible for ensuring you have the necessary rights to the audio content you use.

Copyright and Music Rights

Pulse is a tool for creating visual content. You are responsible for:

• Ensuring you have the legal right to use any music or audio files you import
• Obtaining necessary licenses for any copyrighted music you use in visualizations
• Complying with applicable copyright laws when sharing or publishing visualizations

We do not grant any rights to use copyrighted music and are not responsible for copyright infringement by users.

Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• That the app will be uninterrupted or error-free
• That defects will be corrected
• That the app is free of viruses or other harmful components

Limitation of Liability

To the maximum extent permitted by law, Gigapixel Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the app
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code that may be transmitted to or through the app
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted or shared through the app

Performance Use

When using Pulse for live performances or public displays:

• You are responsible for ensuring your music is properly licensed for public performance
• You should test your setup before live use to ensure proper functionality
• We recommend having backup equipment in case of technical issues

Updates and Changes

We reserve the right to modify or discontinue the app (or any part thereof) at any time with or without notice. We may also update these terms from time to time. Continued use of the app after changes constitutes acceptance of the new terms.

Termination

We may terminate or suspend your access to the app immediately, without prior notice or liability, for any reason, including breach of these terms. Upon termination, your right to use the app will immediately cease.

Governing Law

These terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

Apple App Store

These terms are in addition to and do not replace Apple's Licensed Application End User License Agreement. In case of conflict between these terms and Apple's agreement, Apple's terms shall prevail.
